Regent video gets the flick

A video that touts the dubious wonders of the redevelopment of the Regent Theatre has been pulled from YouTube by Warner Music in a copyright dispute. This follows my action overnight in alerting the management of rising young Scottish singer-songwriter Paolo Nutini that his song New Shoes is used as the soundtrack. Mike Bawden from Nutini's management company, Morse Code Management, told me by email: "We have NEVER approved use of Paolo's track New Shoes. Paolo doesn't have anything to do with this ... and we're a lot p---ed off with it."

I only created this video to

I only created this video to show the public of Brisbane what the development would look like.

I had no intention of creating all this. You must understand I randomly took a song I liked and created a video using the images put on Brisbane's online DA service. At no point in the video did I say "Support the regent" or "destroy the cinema" I just showed the development images.

I want to be a developer, so, I like developments and this particular one has so much going for it. I apologize for using his song, but apart from that I have no regrets creating a video to inform the people of Brisbane about this development.

I think it is pretty clear that you alerted Warner Music just to support your cause and as a result pulling my video from youtube. I can assure you, I will be putting it back on, but with some original music which I will create.

It's absolutely your right to have an opinion and to express it on YouTube, and good on you if you do put it back up. To paraphrase Voltaire, I disagree with what you say but I will defend your right to say it. Let me know when you do put your video back up, and I will publish the fact here - but please use your real name. I've made my position clear because I have the courage of my convictions. If you do too, you'll step out from behind a pseudonym and be proud to declare who you are and what you think.

I applaud you, Mr. Debritz

I applaud you, Mr. Debritz for acting upon what you thought was the right thing. And it was the right thing. These artists, especially the newer, up and rising ones are already struggling to profit from the royalties of their music due to the illegal downloads and sharing all over the internet. The last thing we need is for people/corporations to use these artists' music for promotions without permission and thinking they can get away with it.

Mr. Nutini and his management are rightfully angry over this, and I, one of Paolo's fans are happy that someone like you is watching out for these artists.

With that, I say, thanks on behalf of people from the U.S who are fans of Paolo Nutini.

My response is that doesn't make it right to rip-off people's music. To my mind it's even worse when it's done for a political purpose. I have been observing him for several years now and find it quite fascinating. I believe he has the courage of his convictions like you, however, I feel he may be protecting his loved ones...

I find it very insulting and rude of you to have dobbed the creator of this video in. How dare you create such a fuss over nothing! I saw the video myself. All he did was create a simple video with scrolling photographs of the project. A song was added to simply make the video more interesting to watch, not to support a 'pro-development cause' or whatever manipulative bullshit you labelled it as. Either way I dont care whether this development is built or not, but I find it very childish of you to paint well-meaning people in a bad light to support YOUR cause. By all means go and protest your stupid theatre but without affecting peoples lives and reputations. Thank you.

So I'm rude and insulting. It was the guy who made the video who appropriated somebody else's work without their knowledge or consent to support his cause. Somebody brought the video to my attention and I simply asked the artist's PR person (not the record company) if they were aware his song was being used in this way and whether he supported the tower. he could well have said yes he wanted the tower to be built, and there could have been a story in that. But they said they didn't and they - not me - had the video removed. It's a simply matter of ethics - and, as I said before, the courage of your convictions. Both you and SoulVision are hiding behind pseudonyms, I'm putting my name and my face to a cause I believe in.

I am shocked people are attacking you for your efforts to stop this anonymous person misrepresenting the views of a talented young artist. I really hope Warner Music pursue this wannabe developer for such a blatant act of piracy, and perhaps then he (or she?) will learn that they are not as anonymous on the internet as they believe.

I applaud your convictions in stopping this fraud and all your efforts in saving an historic Brisbane landmark. Brisbane has already lost to many landmarks to profit hungry developers, and the redevelopment plan for The Regent would have destroyed the character and aurora of the area for only another bland office tower.

It would seem this was a lone operator - a development "groupie" if you like- rather than developer itself. What worries me is that this guy (woman?) and a small band of suporters who've commented on the Courier-Mail story seem not to see that it is ethically wrong to associate somebody else's creative work with your own personal crusade.

Their own personal crusade? they dont have have a crusade at all. I have seen the video and read a lot of comments, and this person is not working against your cause, merely sharing a passion with others. The video was not pro or anti your cause and you have dragged this person into it (because of your own personal crusade) and potentionally caused them alot of trouble. I really think you owe them an apology.

Im all for saving the regent, but i think you have really gone a bit far. Lets be honest, it is only because you are trying to push your own agenda that you have "dobbed" this person in. Its a bit of a low act. You seem quite hung up on the fact that they have used someone else's song, but if you were really concerned about true piracy Im sure you would have many other pieces of evidence that demonstrate you have acted before against piracy. If so please let us know. But I think this is a once-off occasion that you have decided to report this because it is allegedly against your cause. And are you so clean and almighty that you have not once ever pirated software, or songs? Even in your past? If you truly havent ever pirated and then your actions may hold some credence. Of course you will probably say you havent merely to add credibility to your argument. Either way it is still a low act, and it even though i want to save the regent it is actions like yours that may turn me against it.

It will be a true test of your character to see if you admit that you may have over stepped the mark.

Yes, I'm unashamedly against the development of the Regent. Guilty on that count. I must admit I didn't realise it was an individual who'd done this; the person who passed it on to me thought (and so did I) that it was part of the developer's campaign - a promotional video if you like. I'm sorry this person feels put upon, but the principle remains the same. As for piracy, yes I once downloaded songs from the original Napster - before legal downloading existed - but I had a policy of only downloading songs I already owned on cassette (that'll give you a clue to my age) and I figured I already owned. I don't even do that now. And, if you care to check the News Limited newspaper archives, you'll see that I wrote stories about music piracy when I was working as a journalist in Brisbane. I can see why people have done it in the past, because record companies were very slow to offer legal alternatives, but that's not the case now. Anyway, in this case it's not the piracy I'm complaining about, it's the appropriation of the music to sell a message. Only the artist has the right to do that. I've seen the video too, and it obviously is in favour of the development - it promotes all the features of the proposed tower and doesn't include any statements against it. This person is not going to face any penalty, and s/he's free to put the video back when it's got an original soundtrack. I even told him (her?) that I'd plug it from this blog when that happens, if I'm informed of it. I don't think I can be fairer than that.
As for the anonymity thing, I stand by my view that a person who is willing to stand on a principle should put their name to it. it does not invalidate an idea to say it anonymously, but it adds weight to a position to proclaim it proudly. I also notice that many of the comments supporting the video-maker here and in other forums have been done anonymously.

Hmmm. A conspiracy

Hmmm. A conspiracy theorist might have a thought about that. All I know is that there are 3000+ people on Facebook all with unique names, and 626 Queensland residents with names and addresses who've signed the official petition to Parliament to save and restore the Regent. What I see on the other side of the argument is a handful of people who go under pseudonyms. Imagine running for Parliament, and saying, "I'm going to do great things, but I won't tell you who I am."
That said, I'm approving and posting anonymous comments here, even if I don't agree with them - which is more than some forums would do.

Not at all, Tim. Just struggling to understand why people would take a strong stand on an issue but not be prepared to identify themselves. And I'm not talking about amusing little posts on a blog, where I'm happy for people to comment anonymously or under a pseudonym, but big issues that can make a difference. Issues like, are the people of Brisbane happy to lose the CBD's last remaining historic theatre in the name of "progress"?
